Discharge Petition

5 June 2006
To: Committee for Justice

When Mr. Daschle said that President Clinton’s nominees were being filibustered in Committee your response was that this was false. In fact you went further and said that no nominee that has majority floor support can be killed in committee because a majority of senators can sign a discharge petition from the floor and the nominee would be released without a committee vote.

If this was the case when Mr. Daschle made his comments then why is it not the case today or are you just looking for a reason to get rid of Mr. Graham becasue he is a member of the Group of 14? Why not persuade a majority to put their nomaes on record as supporting the nomination of Mr.Haynes by doing a discharge petition? This would go around the blue slip and get the nominee on the floor for an up-or-down vote and would force Mr. Graham to place his vote on the record as for against. It would also implore the Group of 14 to make a decision on extraordinary circumstances, which in my opinion, the torture memos are such circumstances.

Please allow the process to work. Persude a majority of Senators to sign a discharge petition to force a vote.
